According to the rules you shouldn't generally post games that use sprites that you don't have the permission to use, but if you ask me the severity of the infraction depends on the sprites that you use. The rule itself mentions Mario for a reason, because Nintendo is super heavy on copyright. That said, I'm not sure where Waldo (pun not intended) is on the scale of copyright offenses. Not saying you should break the rules, but it's not exactly uncommon to see submissions use sprites of characters from popular media franchises...
